All transactions are carried out in accordance with applicable law.

§4. Prices, promotions and presentation of the offer

Prices are shown in euro (EUR); all prices include VAT. Delivery is free of charge. The Customer sees the total amount payable in the cart and in the summary before placing the Order. If discounts are applied, the Seller presents the information required by law, including the lowest price from the 30 days preceding the discount, where applicable. The content of the product page, these Terms and Conditions and the order confirmation are binding.

§5. Conclusion of the contract – order steps

  1. Adding the Product to the cart and proceeding to checkout.
  2. Selecting the delivery method (DHL courier) and the payment method (credit or debit card – Mollie).
  3. Entering the data needed to fulfil the Order, accepting these Terms and Conditions and reading the Privacy Policy and the Cookie Policy.

  5. Confirmation by e-mail that the Order has been accepted for fulfilment, followed by fulfilment and shipment of the Order. The Seller informs the Customer of status changes by e-mail.

The contract is concluded when the Seller confirms acceptance of the Order by e-mail. If the payment is not confirmed, the Order may be cancelled; in that case no contract is concluded.

§6. Electronic services and customer account

The Store provides the following electronic services free of charge: order form, registration and login to the customer account, and contact form. The account allows the Customer to view the order history and address data.

The user may delete the account at any time by contacting the Store’s customer service or using the function in the account panel, if available.

It is prohibited to send through the Store’s forms any unlawful content or content that infringes personal rights, copyright or good practice.

§7. Contact and response time

The Seller replies to enquiries on business days, within 2 business days at the latest. The phone number +48 575 859 907 is answered on business days; if a call is not answered, the Seller calls back or replies by e-mail.

§8. Product content and parameters

The Seller makes every effort to ensure that product descriptions, photos and parameters are accurate and up to date. Colours in photos may differ slightly from reality depending on screen settings; this does not limit the Customer’s rights in the event of a lack of conformity of the goods with the contract.

If in doubt about the properties of a product, its dimensions or use, the Customer may contact the Seller before placing an order.

§9. Payment methods

Orders are paid in advance, online, while placing the order, via the payment operator Mollie B.V. (Keizersgracht 126, 1015 CW Amsterdam, the Netherlands) – by credit or debit card. Payments are made in euro (EUR). The Store does not accept cash or cash on delivery.

Deadline and fulfilment: the order is released for fulfilment once the payment has been confirmed by the payment operator. If the payment is not completed, the Order may be cancelled.

Refunds are made using the same means of payment that the Customer used, unless the Customer expressly agrees to another method that involves no costs for the Customer.

§10. Delivery and shipping

Carrier and cost: DHL courier; delivery is free of charge.

Delivery countries: Belgium, Croatia, Czechia, Hungary, Luxembourg, Slovakia and Slovenia.

Place of dispatch: the Seller’s warehouse, ul. Ogniowa 2/5, 02-495 Warszawa, Poland.

Delivery time: we prepare orders for dispatch within 3–5 business days; transport by DHL courier takes 2–4 business days. The total delivery time is 5 to 9 business days from placing the order. In periods of high demand or in cases of force majeure this time may be extended – the Seller will inform the Customer by e-mail and give a new date.

Shipment tracking: after the parcel has been dispatched, the Customer receives the shipment number by e-mail to track the delivery status.

The Store sells exclusively online; personal collection is not available.

§11. Withdrawal from the contract (14 days)

The Consumer and the Entrepreneur with consumer rights may withdraw from the contract within 14 days of taking possession of the goods, without giving any reason. To meet the deadline, it is sufficient to send the statement before it expires. The instructions on withdrawal and the model form are on the pages “Right of withdrawal” and “Return form”.

Cost of returning the goods: the Consumer bears the direct cost of returning the goods. The Consumer sends the parcel with any carrier to: Falesia Lima – return, ZERIVA sp. z o.o., ul. Ogniowa 2/5, 02-495 Warszawa, Poland, stating the order number and the e-mail address used for the order, no later than 14 days from the day on which the Consumer informed the Seller of the withdrawal.

Condition of the goods: the Consumer is liable for any diminished value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning.

Refund: the Seller reimburses to the Consumer all payments received, including the cost of delivery (except for the supplementary costs of a type of delivery chosen by the Consumer other than the least expensive standard delivery offered by the Store), without undue delay and no later than 14 days from the day on which the Seller received the statement of withdrawal. The Seller may withhold the reimbursement until the goods have been received back or the Consumer has supplied evidence of having sent them back, whichever is earlier. The reimbursement is made using the same means of payment as the Consumer used, unless the Consumer has expressly agreed to another method that involves no costs for the Consumer. In addition, the Seller makes the refund within 5 business days of receiving the goods or the evidence of their dispatch, if that deadline expires earlier.

The right of withdrawal does not apply in the cases set out by law, in particular for goods made to the Consumer’s specifications.

§12. Exchange

Independently of the statutory right of withdrawal, the Seller allows an exchange of the goods for another size or colour of the same product within 14 days of delivery, provided that the product is unused and in unimpaired condition, allowing for ordinary inspection of the goods. The cost of sending the product back for an exchange is borne by the Customer; the cost of shipping the new product is borne by the Seller. The Seller ships the new product within 5 business days of receiving the goods. If the selected variant is not available, the Seller refunds the full amount paid within 5 business days of receiving the goods.

§13. Conformity of the goods with the contract and complaints

The Seller is liable to Consumers and Entrepreneurs with consumer rights for any lack of conformity of the goods with the contract that exists at the time of delivery and becomes apparent within 2 years of that time. In the event of a lack of conformity, the Customer may request repair or replacement of the goods. The Customer may request a price reduction or withdraw from the contract (the latter only if the lack of conformity is not minor) if the Seller has refused repair and replacement or has not carried them out within a reasonable time, if the lack of conformity persists despite repair or replacement, or if it is so serious that it justifies this without first requesting repair or replacement.

Submission: a complaint can be submitted by e-mail to info@falesiastore.com, by post to the Seller’s address or using the complaint form (optional). The complaint should describe the lack of conformity and – where possible – include photos and the order number.

Complaint shipping: the cost of sending back goods under complaint is borne by the Seller. The customer service team indicates how to send them.

Deadline: the Seller replies to a Consumer’s complaint within 14 days of receiving it. If the Seller does not reply within this period, the complaint is deemed accepted. Once the complaint has been accepted, the Customer may choose a refund instead of repair or replacement – the Seller transfers it within 5 business days.

Towards entrepreneurs who are not Entrepreneurs with consumer rights, the Seller’s liability may be limited to the extent permitted by law.

§14. Temporary unavailability, errors and liability

Despite due care, temporary technical interruptions, carrier delays or obvious clerical errors, including in prices, may occur. In the event of an obvious pricing error, the Seller will contact the Customer and propose to continue the order at the correct price or to cancel it at no cost. Towards Customers who are neither Consumers nor Entrepreneurs with consumer rights, the Seller is not liable for indirect damage or lost profits. The Seller is not liable for delays caused by force majeure.

§15. Manufacturer’s warranty

If a manufacturer’s or distributor’s warranty is provided for a product, information on its scope and duration is given in the product description or in the warranty document. The warranty is voluntary and independent of the Customer’s statutory rights in the event of a lack of conformity of the goods with the contract.

§16. Proof of purchase and invoices

The proof of purchase is the e-mail confirming that the order has been accepted for fulfilment. The Seller issues an invoice at the Customer’s request, made in the order notes or by e-mail, and sends it electronically. Invoice details should be given correctly.

§17. Privacy and cookies

The rules for processing personal data are described in the Privacy Policy, and the rules for using cookies and similar technologies in the Cookie Policy. Consent to cookies other than strictly necessary ones is voluntary and can be changed or withdrawn at any time in the cookie settings – the “Cookie settings” link in the page footer.

§18. Technical requirements and rules for using electronic services

To use the Store, a device with Internet access, an up-to-date web browser, an active e-mail address and – to the extent necessary – cookie support are required. Activities that may destabilise the Service or infringe the rights of third parties or good practice are prohibited. The Seller may block an account that breaches the law or these Terms and Conditions.

§19. Out-of-court dispute resolution

The Seller encourages amicable resolution of disputes. As a consumer, you may also use the out-of-court complaint and redress bodies of your country of residence; the European Consumer Centre in your country (ECC-Net) provides free help in disputes with a trader from another EU country. The Seller does not apply a code of good practice within the meaning of Article 2(5) of the Polish Act on counteracting unfair market practices.

§20. Changes to the Terms and Conditions and validity

This version of the Terms and Conditions is effective from 13 October 2026. The Terms and Conditions may be changed for important reasons, in particular changes in law, technological changes or changes in payment and delivery methods. Contracts concluded before a change are governed by the Terms and Conditions in force on the date the Order was placed (the previous version was effective from 2 July 2026).

§21. Final provisions and contact

The contract is governed by Polish law, in particular the Civil Code and the Consumer Rights Act. If you are a consumer habitually resident in another EU country, this choice of law does not deprive you of the protection afforded to you by the mandatory provisions of the law of that country. These Terms and Conditions do not exclude or limit the rights of Consumers under mandatory provisions of law. In any matter the Seller can be contacted at info@falesiastore.com or by phone at +48 575 859 907.
